Subdivision Rules?

I have heard that a particular subdivision in Georgetown, Ky has rules that you can't have a clothesline or a garden!!! Can this be legal? If yes, how? I just can't believe that people aren't allowed to grow their own food. Surely its not true. Has anyone else heard of this?

    It is quite common, and courts have ruled that it is legal. Basically, by buying a home within the subdivision, you are agreeing to obey the rules. Subdivisions can also have rules that you can't have a playscape in your yard, or that your house has to be at least a particular width or height or number of bedrooms, etc etc.

    No clotheslines is a very common subdivision rule; but I think (and hope) that will change as we become more environmentally conscious. I have not heard of subdivisions banning gardens, but I have heard of them requiring them to be in the back yard (not out front).

    We visited a subdivision where people weren't allowed to park their cars on the street or even the driveway ... They had to be parked in the garage only!

    Yes, many housing developments have certain regulations that must be followed in order to reside in the community.

    My subdiv is that way but I do it anyways. I place mine in a way that it is well hidden with a fence and trees and tall bushes. My neighbor can see it plainly but she puts one up too and uses it!!! So she does not tattle on me. I also drape things over my patio furniture and use drying racks out there....again keep it hidden and no one will be the wiser. I live on a corner lot and I still can do it even with two streets and more neighbors looking out their windows at me! It is a silly rule. Maybe tell them it helps the world to be "green"......Good luck!

    Clothesline banning in subdivisions with home owners' associations. It is part of the pact which is a legal contract that you agree to when you buy into the subdivision. Anyone planning to live in an HOA subdivision should always read the pact before buying. I have online pals who technically are not allowed to set their seed flats (open storage containers!) out in the back yard to start plants for their garden. As someone mentioned above, though, they hide and disguise what they are doing.

    Yup, it's called deed restrictions. We see them a lot here in the Houston area since the city has no zoning. This is the only way to control land use in the city, and the tradition migrated out to the suburbs as well.

    I serve as the chair of our HOA's deed restriction committee. Typically we enforce restrictions in the front yard only. Why? Because we are not legally permitted to go onto someone's property to see if there are violations in the back yard, so the only way we can cite a backyard violation is if one of the neighbors files a specific complaint.

    So if you want to put up your clothesline in the backyard, just talk to the neighbors and make sure they are cool with it. If they are fine with it, there probably won't be anyone left to complain.

    I am not allowed a clothesline in my subdivison either.

    Our subdivision has no clothes line rule which i was not aware of. I just put up this umbrella type clothes line inside me fenced bk yard and my neighbour has complained in a SD meeting. We have not formed the HOA yet, the SD rule book states the " no clothes line rule " was not given to us when we bought the house 3 years ago. When the entire world is trying to go green, my SD gives importance to appearance rather than being responsible. We have Leland cypress trees planted on all sides of our bk yard and i am just waiting for these trees grow bigger. Then i can install the clothes line back.
